I think that proposal got interpreted as something which is planned/feasible. But I don't see a way how that could be done in a secure way (encrypted signatures cannot be verified and thus cannot be trusted). See https://github.com/bisq-network/proposals/issues/220#issuecomment-629582705

The current mediation/arbitration system has 100% flexibility anyway (beside that mediators have to give at least 0.003 BTC to the losing side, to leave incentive that this peer cooperates). 
So as long there is no convincing solution for the basic conceptual problems of this proposal I think discussion on the details which payout variations would make sense is lost effort.
